Is Your Business Truly Compliant?

The "Legal Reality"

If you are a business owner or director, you are likely the "Duty Holder." This means you are personally responsible for ensuring a "suitable and sufficient" Fire Risk Assessment is carried out.

The Insurance "Void" Clause

Most commercial insurance policies in the UK contain a "Condition Precedent." This means if you have a fire but cannot prove you had a valid, up-to-date Fire Risk Assessment—or if you failed to act on the assessment's "Significant Findings"—your insurer may legally refuse to pay out for damages.

Unlimited Fines & Legal Action

The Scottish Fire and Rescue Service (SFRS) regularly conducts audits. If your premises are found to be non-compliant, you could face:

Enforcement Notices: Legally binding orders to upgrade safety measures.

Prohibition Notices: The immediate closure of your business until risks are mitigated.

Unlimited Fines: Courts have the power to issue unlimited financial penalties for serious safety breaches, regardless of whether a fire has actually occurred.

Personal Prosecution

Breaching fire safety law is a criminal offence. In cases of systemic failure or negligence, the Duty Holder can face personal prosecution, which can result in a permanent criminal record and, in extreme cases, a custodial sentence of up to two years.

Compliance doesn't have to be complicated.

At Fireplan, we translate complex legislation into practical, actionable steps. We ensure your business is protected, your insurance remains valid, and your people are safe.
